Membership Agreement

1. Membership Terms and Conditions

Your membership is a contractual privilege to participate in the Club’s organized runs and receive all benefits arranged by njoy lifestyle, ltd. for its members.  Members are encouraged to participate in sponsored races in which njoy lifestyle may or may not be represented or participate in, but each member is responsible and required for selecting, registering, and paying for every outside event.

2. Membership Dues

All membership dues must be prepaid.  Your dues are payable prior to any participation in any Running Club program or event.  Dues are non-refundable and may be subject to increase. 

3. Termination

You may cancel this Membership Agreement at any time.  As stated above in Item 2, even in the event of member initiated termination, dues are non-refundable.  njoy lifestyle, ltd., reserves the right to terminate your membership agreement at any time with reason and shall not return any portion of membership dues already paid.  Further, njoy lifestyle reserves the right to terminate your membership without reason and shall return the pro-rate share of dues paid in such an event.

4. Guest Policy

Each Member shall receive two (2) guest passes for his/her use during the 2010 season.  Additional guest passes are available for purchases of $10 each.  Guest must sign a waiver release to be able to participate in the runs.

5. Rules and Regulations

Each Member must carry a current form of identification (State Drivers License, ID Card, RoadID or similar) at all times.

Acknowledgement, Waiver, and Release from Liability Agreement

PLEASE READ CAREFULLY BEFORE SIGNING THIS ACKNOWLEDGMENT, WAIVER AND RELEASE FROM LIABILITY AGREEMENT (“AWRL”)

I desire to engage voluntarily in cardiovascular and/or resistance and/or Asian bodywork therapy (hereinafter “the activities”) with njoy lifestyle, ltd.  I acknowledge that the activities, including, but not limited to: swimming, biking, running, multisport programs, weightlifting, conditioning, stretching and message therapy, are a test of a person’s physical and mental limits and carries with them the potential for death, serious injury, and property loss. I also acknowledge that part of the activities may be held outdoors, which carries additional risk, including but not limited to, those caused by terrain, facilities, temperature, weather, environment, vehicular traffic (include maritime vehicles), lack of hydration and actions of other people, including but not limited to, other participants, pedestrians, spectators and instructors.  I hereby assume the risks of participating in the activities. 

I certify that I am physically fit and have not been advised against participation by a qualified health professional.  I agree and warrant that if, at any time, my condition changes, I will immediately discontinue participation in the activity. I acknowledge that my statements on this AWRL are being accepted by njoy lifestyle in consideration for allowing me to participate in the activities and are being relied upon by njoy lifestyle, ltd.

On behalf of myself, my heirs, assigns, administrators, executors, next of kin, and for anyone else who might sue on my behalf; it is my intent to take these actions.  I waive, release, and discharge from any and all claims, losses, or liabilities for death, personal injury, partial or permanent disability, property damage, medical or hospital bills, theft, or damage of any kind, including economic losses which may in the future arise out of or relate to my participation in any njoy lifestyle, ltd. activity the following persons or entities: njoy lifestyle, ltd., and the officers, directors, employees, representatives, and agents of njoy lifestyle, ltd., of any of the above, even if such claims, losses or liabilities are caused by the negligent acts or omissions of the persons I am hereby releasing or are caused by the negligent acts or omissions of any other person or entity. 

I agree not to sue any of the persons or entities mentioned above for any of the claims, losses or liabilities that I have waived, released, or discharged herein. 

I indemnify and hold harmless the persons or entities mentioned above from any and all claims made or liabilities assess them as a result of my actions or inactions, the actions, inactions, or negligence of others, including those parties hereby indemnified.

I hereby affirm that I have read this document and I understand its contents and that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.
